The High Court has declined the release on bail of the South Sudan national accused of defiling a five year old girl.
Judge Luka Kimaru said Mr Makoy Deer has no permanent residence in his ruling on Friday.
Kimaru further noted that Kenya does not have an extradition treaty with South Sudan.
Senior Principal Magistrate Timothy Okello had granted Deer release on a Sh1 million bond on Tuesday.
Okello said his eligibility for bail could not be undermined because he is a foreigner.
State counsel Jacinta Nyamosi however appealed against it saying he was a flight risk and that the charges against him are serious.
The 30 year old man allegedly committed the offence on March 3 at Nyayo estate in Embakasi, Nairobi. Kenya.
